These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MyFamilyHQ LLC, a Pennsylvania limited liability company ("MyFamilyHQ LLC," "we," "our," or "us"), governing your access to and use of the MyParentHQ mobile application ("the App").
These Terms apply to all users of the App, including account owners, trusted members, invited caregivers, viewers, and beta testers. These Terms incorporate by reference our Privacy Policy. MyFamilyHQ LLC reserves the right to modify these Terms at any time. Material changes will be communicated via email and via in-app notice.
MyParentHQ is a digital organized binder — a personal caregiving organization tool that helps adult children and family caregivers organize, store, and share information about an aging parent's life. MyParentHQ provides structure for organizing information that users choose to enter. It does not generate, verify, validate, interpret, or act upon the information stored within it.
The App is intended for use by individuals 18 years of age or older. By using the App, you affirmatively represent and warrant that you are at least 18 years of age. The App is not directed to children under the age of 13 and we do not knowingly collect personal information from children under 13 in accordance with COPPA. If we discover a user is under 18, we reserve the right to immediately suspend or terminate that account and delete all associated data without prior notice or refund. If you believe your child under 13 has created an account, contact us at hello@myparenthq.com with subject line "COPPA Request."
You must create an account to access the full features of the App. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.
You agree to use a strong unique password, not share your credentials, notify us immediately at hello@myparenthq.com if you suspect unauthorized access, and keep your registered email address current.
You may only create one account per person. Creating multiple accounts to circumvent restrictions or abuse free trial periods is prohibited.
Prior to public launch, the App may be available to beta testers through Apple's TestFlight platform. Beta testers are subject to these Terms in addition to the MyParentHQ Beta Tester Brief. Beta testers are instructed not to enter personally identifiable information about real individuals during beta testing.
By creating a parent profile, you represent that you have the legal authority, appropriate consent, or a good faith family caregiving relationship that permits you to organize and store information about that individual, and that your use complies with all applicable laws.
MyParentHQ recognizes that the majority of family caregivers act in informal capacities without formal legal documentation. The App is designed to serve these users.
Where the individual has diminished cognitive capacity, you represent that your use of the App is consistent with your legal authority and good faith caregiving responsibilities. MyFamilyHQ LLC is not equipped to assess questions of legal capacity.
The App may not be used to facilitate elder abuse, financial exploitation, identity theft, or any other harm to the individual whose information is stored. MyFamilyHQ LLC expressly prohibits any use of the App that constitutes elder abuse under applicable law.
MyParentHQ is designed for personal family caregiving use, not for commercial use by professional caregiving agencies managing multiple unrelated clients without a separate written agreement with MyFamilyHQ LLC.
As an account owner, you are solely responsible for all parent profiles you create, all information you enter, and all access you grant to trusted members, caregivers, and viewers.
The App allows you to invite individuals at one of three access levels. Every invitation requires explicit acceptance:
Invited users agree to access only information they have been explicitly granted access to, use information solely for caregiving purposes, and not share information with unauthorized third parties.
Information accessed through the Viewer role is not a verified clinical record. Professional caregivers must independently verify all information through appropriate clinical channels before acting on it in a professional capacity.
Account owners may revoke access at any time without notice. Revocation takes effect immediately.
All information you enter ("User Content") remains yours. You retain full ownership of your User Content. By using the App, you grant MyFamilyHQ LLC a limited license to store, process, and display your User Content solely for operating the App. This license terminates when you delete your account.
You are solely responsible for the accuracy, completeness, currency, and legality of all User Content you enter. MyFamilyHQ LLC does not verify any User Content. You are strongly encouraged to verify all medical information with qualified healthcare professionals and maintain independent backup records.
Software errors may occasionally cause information to display incorrectly, fail to save, or become temporarily unavailable. MyFamilyHQ LLC is not liable for any consequence arising from a technical failure of the App. Maintaining a printed or alternative backup of critical information is strongly recommended.
MyFamilyHQ LLC does not guarantee uninterrupted availability of the App. In any emergency situation, always call 911 first. MyFamilyHQ LLC is not liable for any harm resulting from App unavailability during an emergency.
Hospital Mode and the Emergency Packet are information display features that organize and present existing User Content. They do not generate, certify, verify, or clinically interpret any information. They are supplements to — not substitutes for — verified medical records, clinical judgment, and emergency services.
MyParentHQ offers tiered subscription plans. Each tier provides access to all modules with a defined capacity for the number of parent profiles and care team seats. Only the account owner pays; invited members are not charged.
MyParentHQ offers a free trial period. The free trial begins once you have added information across at least four (4) modules in the App — not at the time of download, account creation, or your first saved record. At the conclusion of the free trial, a subscription is required to retain full access. If you do not subscribe, your access will be limited to the Emergency Packet in read-only mode. Your data is preserved in full regardless of subscription status.
If you choose to subscribe, your subscription automatically renews at the applicable rate unless canceled at least 24 hours before renewal.
All subscriptions are billed through Apple's App Store In-App Purchase system (iOS) or Google Play's billing system (Android). MyFamilyHQ LLC does not directly collect or store your payment information. Refund requests must be submitted to Apple or Google directly.
Cancel at any time through your device's subscription management settings. On iOS: Settings → [Your Name] → Subscriptions → MyParentHQ → Cancel Subscription. Cancellation takes effect at the end of the current billing period. Canceling does not delete your account or data.
If your trial expires or subscription lapses, access is limited to the Emergency Packet in read-only mode. All other modules are inaccessible until a subscription is activated. Your data is fully preserved and accessible again upon resubscribing.
All digital goods and subscription services within the App are sold exclusively through Apple's In-App Purchase system (iOS) or Google Play's billing system (Android) in compliance with each platform's guidelines. No external payment methods are offered for digital subscriptions within the App.
The account owner retains full control over all parent profiles they have created, including the right to add, edit, delete, or share profile information.
The individual whose information is stored ("the Data Subject") retains rights over their own personal information consistent with applicable privacy law including GDPR and CCPA. A Data Subject may request deletion by contacting hello@myparenthq.com with subject line "Data Subject Deletion Request." MyFamilyHQ LLC will process verified requests within 90 days.
Upon the death of the individual whose information is stored, the account owner retains control of the profile. MyFamilyHQ LLC does not adjudicate family disputes over profile access following the death of the Data Subject.
You may delete your account at any time through Settings → Delete Account within the App, or by contacting hello@myparenthq.com. Account deletion is permanent and irreversible. Upon deletion, your account and all associated data will be permanently deleted within 90 days, all trusted members and caregivers will immediately lose access, and your subscription will be canceled at the end of the current billing period.
Subscription transaction records maintained by Apple, Google, and our subscription management provider may be retained after account deletion for financial compliance purposes.
MyFamilyHQ LLC may suspend or terminate your account at any time for violation of these Terms, harmful conduct, fraudulent or illegal activity, or failure to pay subscription fees.
By creating an account, you consent to receive transactional communications necessary for the operation of the App, including invitation notifications, account security alerts, subscription notices, trial expiration reminders, and material changes to these Terms or our Privacy Policy. You may opt out of non-essential marketing communications at any time by contacting hello@myparenthq.com.
The App, including its design, features, text, graphics, logos, and software, is owned by MyFamilyHQ LLC or its licensors and is protected by United States and international intellectual property laws. Subject to your compliance with these Terms, MyFamilyHQ LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal mobile device for personal non-commercial caregiving purposes.
You represent that you are not located in, and are not a national or resident of, any country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Your use of the App is governed by our Privacy Policy at myparenthq.com/privacy, incorporated into these Terms by reference. Key commitments: we do not sell your personal information, we do not use your information for advertising, and you are the custodian of your own data.
You agree to defend, indemnify, and hold harmless MyFamilyHQ LLC, its officers, directors, employees, members, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use or misuse of the App, User Content you enter, your violation of any third party's rights, or any claim arising from your lack of authority to create a parent profile.
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States of America, without regard to conflict of law principles.
Before initiating formal dispute resolution, contact hello@myparenthq.com with subject line "Dispute Notice" describing your claim. Allow 30 days for informal resolution.
Unresolved disputes shall be resolved by binding individual arbitration in Pennsylvania or via remote hearing, applying Pennsylvania law. The arbitrator's decision is final and binding. Either party may seek emergency equitable relief in any court of competent jurisdiction to prevent irreparable harm.
Any claim arising out of or related to these Terms must be filed within one year after the claim arose or it will be forever barred.
The following provisions are required by Apple for apps distributed through the App Store. In the event of any conflict between these provisions and other provisions of these Terms, these provisions shall control with respect to App Store distribution.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and MyFamilyHQ LLC with respect to the App and supersede all prior agreements. MyFamilyHQ LLC's failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
